This workshop is presented by subject matter expert and industry specialist to ensure a high and most current standard of excellence in all our workshops and trainings.  Facilitated byAssistant Professor Lim Lei Theng, who was again in the news recently for leading the NUS moot team to win a global law competition, beating over 500 law schools from 80 countries, among them, Harvard University, Oxford University, and Beijing Foreign Studies University and others.

A/Prof Lim Lei Theng was a litigation lawyer at Drew & Napier, one of Singapore’s largest and leading law firms.  Her legal practice centered on civil suits and arbitrations involving cross-border transactions.  Lei Theng has an LLB (Hons) from the National University of Singapore and an LLM from Harvard Law School.  Now serving as a Deputy Director of the Legal Writing Programme, she convenes and teaches two courses – Introduction to Trial Advocacy and Legal Case Studies, to second-year law students.  She also teaches Legal Analysis, Writing and Research course, and assists in coaching the NUS moots teams.

She has taught negotiation and mediation in numerous public workshops in Singapore, Malaysia and Jakarta.  Within educational institutions, her teaching has taken her from the law faculty to the LKY School of Public Policy and its predecessor institution.  She has also taught in several executive programs on negotiation in conjunction with the NUS Public Policy Program, Conflict Management Group and the Kennedy School of Government of Harvard University.  A/Prof Lei Theng was part of the Committee of ADR under the Ministry of Law that assisted in the establishment of community mediation in Singapore.

Overview

Some of the issues that may arise for a hearing include how to convene the hearing, who should be present, and at what part of the hearing, how may proof be presented, how may testimony be recorded, how to maintain order and decorum, how to deal with parties not represented by lawyers, whether the hearing should be adversarial or inquisitorial and what merits there are to either, how to deliver the decision in a fair and unobjectionable manner.

“An adjudicatory proceeding must not only be a fair hearing but it must also be seen to be a fair hearing.”

Some agencies and organizations have established disciplinary or enquiry proceedings where officers or staff may be conducting a hearing.  Many of those tasked with conducting a hearing may not be legally trained.  Even those who are legally trained are not specifically trained to conduct hearings.

A proper hearing that gives rise to outcomes that can stand up to scrutiny must be orderly, fair and transparent.  Evidence and witness testimony should be collected in a fair manner and collated in a sensible fashion.  Due process and natural justice should be observed.  Questioning of witnesses must be done fairly, and effectively.

This workshop is possibly the only one of its kind in Singapore that is run by a private company.

Facilitated by lawyer and Assistant Professor from NUS Law School, this workshop aim to impart the skills and knowledge necessary to conduct a fair hearing.
